Terms of Service

By creating an account and using TSP Scale, you agree to be bound by these Terms of Service. TSP Scale is a B2B platform intended strictly for businesses and developers. You must be at least 18 years old or legally authorized to act on behalf of a business to use this service. Users are responsible for complying with all applicable laws and regulations governing their use of the service, including email, privacy, consumer protection, and anti-spam laws that apply to them. If you do not agree with these terms, you are prohibited from using our service.

TSP Scale strictly prohibits the use of our infrastructure for abuse. You may not use the service for: • Sending spam or unsolicited bulk email. • Phishing, fraud, or impersonation. • Distributing malware, ransomware, or malicious attachments. • Distributing illegal or abusive content. • Using purchased, scraped, or harvested mailing lists. • Attempting to bypass rate limits or security controls. • Violating intellectual property rights. We may apply sending limits, reputation controls, verification requirements, or temporary restrictions to protect platform reliability and email deliverability. We may suspend, restrict, or terminate access with or without prior notice where reasonably necessary to protect the Service, other users, or comply with applicable law.

You are solely responsible for maintaining the confidentiality of your account credentials and securing your API keys. You are fully responsible for all activities performed using your account. Users are solely responsible for the legality, accuracy, and authorization of the emails and content transmitted through their accounts. You must promptly notify TSP Scale of any unauthorized access or security breaches. We may require users to verify identity, domain ownership, email addresses, or payment information before enabling certain features.

Users retain full ownership of their own content, emails, and data. TSP Scale retains all intellectual property rights and ownership of the platform, software, branding, and documentation. Nothing in these Terms transfers ownership of TSP Scale's intellectual property to users.

We target high availability and aim for 99.99% uptime; however, availability is not guaranteed unless covered by a separate Service Level Agreement. Furthermore, the service is provided on an 'AS-IS' and 'AS-AVAILABLE' basis without any warranties of any kind, either express or implied. We are not liable for business loss resulting from delivery delays caused by recipient mail server behavior or internet infrastructure failures beyond our control. Email delivery depends on factors outside TSP Scale's control, including recipient mail server policies, spam filters, domain reputation, DNS configuration, and internet routing. TSP Scale does not guarantee that every message will be accepted or delivered by recipient systems.

We may modify, improve, or discontinue features of the Service from time to time. Where changes materially affect paid services or these Terms, we will provide appropriate notice.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, widespread internet outages, government actions, or major infrastructure failures.

To the maximum extent permitted by applicable law, TSP Scale and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service.

Subscriptions are billed in advance on a recurring monthly or yearly basis. You may cancel your subscription at any time through the dashboard. No refunds are provided except where required by law. Users may request account closure through the dashboard or available support channels. Upon termination, live account data will be deleted according to our Privacy Policy and retention schedule, but certain records (such as billing or consent records) may be retained longer where required for legal, security, or compliance purposes.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

Users agree not to use the Service in violation of applicable export control laws, trade sanctions, or embargoes.

These Terms, together with the Privacy Policy and any additional agreements expressly incorporated by reference, constitute the entire agreement between you and TSP Scale regarding the Service.
